ACCEPTABLE USE POLICY

THE WEB EMPIRE LLC

Effective October 14, 2026

Hosting • Email • Security • Abuse Prevention

1. Purpose and Scope

This Acceptable Use Policy (“AUP”) governs website hosting, managed hosting, server resources, and related infrastructure services supplied or managed by The Web Empire LLC (“The Web Empire,” “Company,” “we,” or “us”). It applies to customers, account holders, authorized users, and persons acting through their covered accounts (“Customer” or “you”). Customers must ensure that their personnel and authorized users comply.

This AUP does not independently regulate hosting purchased and managed entirely through an unrelated third party, unless expressly incorporated into a separate written agreement. Third-party email systems configured or supported by The Web Empire remain subject to their providers’ own policies; this AUP governs The Web Empire’s covered hosting infrastructure and activities conducted through it.

2. Lawful and Responsible Use

Customers must use covered services lawfully and without materially impairing others’ security, privacy, or access. Prohibited uses include fraud, unlawful content, infringement, abuse, deceptive impersonation, unlawful data collection, evasion of security restrictions, and conduct creating substantial legal, operational, or reputational risk to covered infrastructure. Customers must comply with applicable laws and relevant upstream-provider restrictions.

3. Spam and Electronic Communications

Covered infrastructure may not be used for unlawful unsolicited bulk email, deceptive sender identities, forged headers, harvested mailing lists, open relays, compromised-mailbox spam, spam-filter evasion, or abusive messaging. Legitimate marketing must satisfy applicable CAN-SPAM and other relevant requirements, including truthful identification and legally required opt-out mechanisms.

The Web Empire may throttle, restrict, or suspend sending privileges when spam complaints, blacklisting, compromised accounts, or sending volumes threaten other customers or provider reputation. Email deliverability and inbox placement are not guaranteed.

4. Malware, Phishing, and Harmful Content

Customers may not knowingly host or transmit viruses, ransomware, spyware, trojans, malicious redirects, phishing pages, credential-stealing tools, fraudulent downloads, or attack infrastructure. A compromise may occur without the Customer’s knowledge and does not by itself establish intentional wrongdoing; nevertheless, the Customer must cooperate in investigation and remediation and secure systems within its responsibility.

5. Maintenance Coverage and Malware Remediation

5.1 Active maintenance plan. Where the Customer maintains an active maintenance or security plan with The Web Empire, The Web Empire will investigate and remediate malware to the extent expressly covered by that plan, without separate charges for included work. Coverage, response expectations, exclusions, and service levels are determined by the applicable plan. No plan implies unlimited incident response, reconstruction, recovery of missing backups, or remediation of unrelated third-party systems unless expressly stated.

5.2 No active maintenance plan. The Customer is responsible for malware removal, securing compromised software and credentials, and restoration. The Web Empire may offer remediation for a separately approved fee and scope; complimentary cleanup is not required.

5.3 Containment. Regardless of maintenance status, The Web Empire may isolate or temporarily suspend an affected service when reasonably necessary to protect infrastructure, customers, or third parties. We ordinarily seek to notify the Customer first, except where a serious or imminent threat requires immediate action.

5.4 Recovery limits. Complete removal, restoration, and data recovery cannot be guaranteed. Contractual obligations expressly assumed under an active maintenance plan remain in effect.

6. Unauthorized Access and Security Testing

Prohibited conduct includes unauthorized access, credential stuffing, brute-force attacks, exploitation, interception, unauthorized vulnerability scanning, denial-of-service attacks, bypassing access controls, and use of compromised systems to attack others. Penetration tests or scanning against covered infrastructure require prior written approval defining scope, timing, and safeguards. Customers must not install unauthorized cryptocurrency miners or similar abusive processes.

7. Hosting Resource Abuse and Fair Use

Customers must observe applicable CPU, memory, disk, bandwidth, database, process, and email limits. Activities that materially degrade shared hosting or create disproportionate load are prohibited, including abusive crawlers, persistent unauthorized daemons, excessive database queries, proxy or VPN exit services, cryptocurrency mining, and mass file distribution inconsistent with the hosting plan.

“Unlimited” or “unmetered” descriptions, where used, do not permit usage that compromises shared infrastructure. We may apply reasonable technical limits, request corrective action, or recommend a different hosting plan. Advance notice will be provided where practicable, but urgent restrictions may be imposed to protect systems.

8. Applications, Extensions, and Updates

Customers must use lawfully licensed software and reasonably maintain CMS platforms, themes, plugins, Joomla components, WordPress extensions, scripts, APIs, and custom applications, except where a written service agreement assigns particular tasks to The Web Empire. Customers may not knowingly operate pirated, malicious, or materially unsafe software.

The Web Empire may request removal or correction of vulnerable software and may disable it when reasonably necessary for security. Included maintenance duties remain governed by the active maintenance agreement.

9. Credentials and Account Access

Customers should use strong unique passwords, multifactor authentication where available, restricted administrator access, and prompt access revocation. Suspected credential compromise must be reported promptly. The Web Empire may reset passwords, terminate sessions, or temporarily restrict compromised access to protect systems. Account responsibility is subject to applicable law and does not excuse The Web Empire’s own legally established misconduct or contractual breach.

10. Email and Third-Party Providers

The Web Empire may supply hosting directly and may configure or support third-party email platforms. Third-party providers may independently impose restrictions or suspend service. SPF, DKIM, DMARC, MX, and related DNS assistance is provided only to the extent within the agreed service scope. We do not guarantee uninterrupted third-party email availability, delivery of every message, or inbox placement. Third-party actions are subject to applicable agreements and law.

11. Prohibited Content

Covered services may not knowingly be used for unlawful fraud, phishing, intellectual-property infringement, illegal disclosure of private data, unlawful threats, child sexual abuse material, or other illegal exploitative content. The Web Empire has no general obligation to review every customer file or message, but may investigate credible complaints and respond as permitted or required by law.

12. Security Incidents and Reporting

A security incident may include malware, unauthorized access, credential theft, phishing, data exposure, or disruptive traffic. Customers must promptly report suspected incidents affecting covered services to This email address is being protected from spambots. You need JavaScript enabled to view it. and reasonably cooperate with containment and investigation.

The Web Empire will make commercially reasonable efforts to notify affected Customers of material incidents when appropriate and as required by law or contract. Notification may be delayed where necessary for containment, legal compliance, or investigation. Each party retains its own applicable breach-notification obligations.

13. Monitoring and Investigation

The Web Empire may reasonably review security alerts, server logs, operational indicators, and credible abuse reports; investigate suspected violations; restrict abusive processes; and cooperate with upstream providers or lawful authorities. Monitoring is subject to applicable law, contractual obligations, and the Privacy Policy. This provision does not create a duty to continuously monitor every Customer website or application.

14. Notice, Suspension, and Termination

14.1 General approach. The Web Empire may warn, require corrective action, restrict, suspend, or terminate affected services proportionately to a substantiated violation and consistent with applicable agreements and law.

14.2 Ordinary notice. Where reasonably practicable, we will notify the Customer of the issue and allow an appropriate opportunity to correct it before suspension.

14.3 Emergency action. Immediate suspension or isolation without advance notice is permitted where we reasonably determine that a serious or imminent threat exists, including active malware, phishing, credential theft, denial-of-service activity, severe spam, unauthorized access, material shared-server instability, or urgent upstream-provider requirements. We will seek to notify the Customer afterward when appropriate.

14.4 Reinstatement. We may condition restoration on removal of malware, security patches, credential changes, proof of corrective measures, or other reasonable protections. Work outside a covered maintenance plan may be separately billable.

14.5 Repeat abuse and recurring compromise. The Web Empire may escalate enforcement, including permanent termination of affected hosting, when a Customer repeatedly violates this AUP, disregards reasonable written security or abuse notices, fails to remedy recurring vulnerabilities within a reasonable period, or repeatedly exposes infrastructure or other customers to material risk. Where practicable, we will provide written notice of the pattern and an opportunity to cure. We may act immediately if recurrence creates a serious or imminent threat. Termination remains subject to the governing agreement and applicable law.

14.6 Hosting expiration. Suspension, investigation, or remediation does not extend the paid hosting term. Hosting ends immediately upon expiration of the last paid hosting period, with no complimentary grace days. Hosting expiration is separate from ownership and licensing of website materials and from SEO services.

15. Backups, Data, and Migration

Customers must maintain suitable copies of critical data unless a written agreement expressly provides backup services; any included backup frequency, retention, and restoration obligations are governed by that agreement. Neither suspension nor malware remediation guarantees that all files, email, databases, or configurations can be recovered.

Where the hosting agreement requires migration notice and initiation at least thirty (30) calendar days before paid hosting expiration, that requirement remains applicable. The Web Empire does not guarantee post-expiration retrieval or recovery, and migration assistance is separately scoped unless expressly included. Nothing here overrides nonwaivable legal duties.

16. Upstream Infrastructure

Covered services may rely on hosting companies, data centers, registrars, cloud networks, CDNs, and security vendors. Applicable upstream restrictions may require The Web Empire to limit or suspend activity. We may implement those restrictions as reasonably necessary. Responsibility for independent third-party outages or enforcement is governed by applicable contracts and law.

17. Remediation Charges and Cost Recovery

Customers may be responsible, to the extent allowed by law and their agreements, for reasonable costs directly associated with their prohibited activities or remediation outside contracted coverage. These may include additional malware cleanup, abuse investigations, restoration, and upstream charges. Work expressly included in an active maintenance plan will not be charged again solely because an incident occurred. Separately billable work ordinarily requires authorization unless the governing agreement permits the charge or urgent protective action is reasonably necessary. No duplicate recovery is permitted.

18. Liability and Indemnification

The applicable signed service agreement controls indemnification, limitations of liability, warranties, and remedies. This AUP does not independently expand an indemnity beyond the parties’ enforceable agreement. Nothing excludes liabilities that cannot legally be excluded or relieves The Web Empire of duties expressly assumed by contract.

19. Service and Security Limitations

No internet-connected system is immune to compromise or interruption. Except as expressly promised in a signed agreement, The Web Empire does not guarantee uninterrupted service, prevention of all incidents, or complete recovery after a failure. This clause does not reduce express maintenance or service-level obligations.

20. Reporting Abuse and Contact

Send reports of phishing, spam, malware, unauthorized access, and suspected violations to This email address is being protected from spambots. You need JavaScript enabled to view it.. Include the affected domain, relevant timestamps, and available evidence. Reports will be assessed based on credibility, urgency, and applicable obligations; a particular response time or outcome is not guaranteed unless contractually required.

21. Incorporation and Order of Precedence

The Web Empire’s hosting agreements and order forms should expressly incorporate this AUP by reference at https://thewebempire.us/acceptable-use-policy, including a statement that the Customer agrees to comply with the version effective under the agreement. A signed agreement’s expressly negotiated provisions prevail over inconsistent AUP language unless the agreement lawfully states otherwise.

This AUP does not change website intellectual-property ownership or licensing, SEO commitments, payment obligations, maintenance coverage, renewal terms, or agreed dispute procedures. Incorporation and amendments are effective only in accordance with the applicable contract and law.

22. Policy Changes

The current AUP will be posted at https://thewebempire.us/acceptable-use-policy. Material changes will be communicated and become effective as required by the applicable agreement and law. Continued use may constitute acceptance only where legally and contractually effective. Changes do not retroactively alter accrued rights where prohibited.

23. Governing Law and Disputes

The signed agreement’s governing-law, venue, and dispute-resolution provisions control. If none applies, Florida law governs without regard to conflicts rules, and appropriate courts in Palm Beach County, Florida have jurisdiction to the extent legally permissible.

24. Severability

If any provision is unenforceable, it will be limited or severed as necessary and the remainder will remain effective to the extent permitted by law.
